These Terms & Conditions ("Terms") govern your access to and use of the Luminaries website, programs, curriculum, digital content, and related services (collectively, the "Services") operated by Luminaries Creative Scouts ("Luminaries," "we," "us," or "our"). By using the Services or enrolling a child, you ("you," the "Parent/Guardian") agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

The Services are intended for children ages 5–10 enrolled by a parent or legal guardian who is at least 18 years of age. By enrolling a child, you represent that you are the child's parent or legal guardian and have full authority to bind the child to these Terms.

2. Enrollment & Payment

All fees are stated at the point of enrollment. Payment is due in full at the time of enrollment unless a payment plan is expressly offered and accepted in writing. You are responsible for keeping payment information current. Late or failed payments may result in suspension or termination of enrollment.

3. No Refunds

All sales are final. Please see our No-Refund Policy, which is incorporated into these Terms by reference.

4. Code of Conduct

Participants and their families agree to treat facilitators, other families, and children with respect. Luminaries may, in its sole discretion, remove any participant whose behavior is disruptive, unsafe, or inconsistent with our mission, without refund.

5. Health, Safety & Assumption of Risk

Luminaries programs involve craft tools, art materials, outdoor activity, and physical movement. You acknowledge that participation carries inherent risks including but not limited to minor cuts, scrapes, allergic reactions, and accidents. You voluntarily assume all such risks on behalf of yourself and the enrolled child, and you release Luminaries, its founders, employees, contractors, facilitators, and affiliates from any liability arising from participation, to the fullest extent permitted by law.

6. Media Release

Photos and video may be captured during programming. Unless you notify us in writing to opt out, you grant Luminaries a non-exclusive, royalty-free, perpetual license to use such images for educational, marketing, and promotional purposes without compensation.

7. Intellectual Property

All curriculum, lesson plans, badges, patches, artwork, written materials, videos, trademarks (including "Luminaries," "Wunder Mix™," and related marks), and other content are the exclusive property of Luminaries. You may not copy, redistribute, resell, publish, or create derivative works from any Luminaries content without prior written permission.

8. User-Generated Content

If you or your child submits artwork, photos, or comments to Luminaries, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, and display such submissions in connection with the Services. You represent that any content submitted is original and does not infringe any third-party rights.

9. Third-Party Services

The Services may link to or integrate with third-party platforms (payment processors, hosting, email, etc.). We are not responsible for third-party content, policies, or practices.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee any specific educational outcome.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMINARIES' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO LUMINARIES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL LUMINARIES BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to defend, indemnify, and hold harmless Luminaries and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your or your child's use of the Services or breach of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, without refund. Sections that by their nature should survive termination will survive.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws rules. Any dispute shall be resolved exclusively in the state or federal courts located in Baltimore, Maryland, and you consent to personal jurisdiction there. You and Luminaries each waive the right to a jury trial and the right to participate in a class action.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
